Am 1. November 2010 hat der ausschlieliche Gerichtsstand des 32b ZPO fr kapitalmarktinformationsbedingte Schadensersatzklagen und bernahmerechtliche Erfllungsklagen seinen 5. Geburtstag gefeiert. Das fnfjhrige Jubilum gibt Anlass zur Bestandsaufnahme ber Erfolg bzw. Misserfolg der in Literatur und Rechtsprechung lebhaft diskutierten Zustndigkeitsnorm. In ihrem nicht immer erfolgreichen Bemhen um die Konkretisierung des Anwendungsbereichs der ausschlielichen Zustndigkeit haben Rechtsprechung und Literatur auf der Rechtsfolgenseite insbesondere das Konkurrenzverhltnis innerhalb der Gerichtsstand-Dreifaltigkeit des 32b ZPO vernachlssigt.
